Welcome to Not School Days. These Terms of Service (“Terms”) govern your access to and use of the Not School Days website, mobile services, marketplace, and related services (collectively, the “Platform”).
By accessing or using Not School Days, creating an account, listing a camp or program, or booking a camp or program through the Platform, you agree to these Terms.
1. About Not School Days
Not School Days is an online marketplace that connects parents, guardians, and other customers (“Customers”) with independent camp operators, activity providers, organizations, businesses, and other program providers (“Providers”).
Not School Days provides technology that allows Providers to advertise programs and allows Customers to search for, compare, and book available camps and activities.
Unless expressly stated otherwise, Not School Days does not own, operate, manage, supervise, staff, or control the camps or programs listed on the Platform.
Providers are independent third parties and are solely responsible for the camps, activities, services, staff, facilities, transportation, supervision, licensing, insurance, safety procedures, and other services they provide.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or complete a booking through Not School Days.
You are responsible for providing accurate and current information when creating an account or making a booking.
You are responsible for maintaining the confidentiality of your account information and for all activity conducted through your account.
3. Camp and Program Listings
Providers are responsible for ensuring that all information contained in their listings is accurate, complete, and up to date.
This includes, but is not limited to:
Camp dates and times
Camp location
Age requirements
Pricing
Available spaces
Program descriptions
Eligibility requirements
Refund and cancellation policies
Health or medical requirements
Items participants must bring
Any additional fees or restrictions
Not School Days does not guarantee the accuracy of information submitted by Providers.
Providers are responsible for updating availability and removing or modifying listings when spaces are no longer available.
4. Bookings
When a Customer books a camp or program through Not School Days, the Customer is entering into an agreement with the Provider offering that camp or program.
The Provider is responsible for delivering the camp or program described in the listing.
Customers are responsible for reviewing all listing details before completing a purchase.
A booking is subject to any additional requirements or policies disclosed by the Provider.
5. Payments and Platform Fees
Payments made through Not School Days may be processed by third-party payment processors.
By making or accepting a payment through the Platform, you agree to comply with any applicable terms and conditions of the payment processor.
Not School Days may charge Customers, Providers, or both a platform fee, service fee, transaction fee, or other fee as disclosed before the transaction is completed.
Fees charged by Not School Days are separate from the services provided by individual Providers.
6. Refund and Cancellation Policy
Each Provider is responsible for establishing its own refund and cancellation policy.
The refund policy displayed on the individual camp or program listing at the time of booking will generally govern the Customer's eligibility for a refund.
Customers are responsible for reviewing the Provider's posted refund and cancellation policy before completing a booking.
Refund Requests Within 14 Days of Booking
Customers who have a refund or cancellation issue should contact the Provider and/or Not School Days as soon as possible.
Not School Days may assist with refund requests submitted within fourteen (14) calendar days of the original booking date. Any refund remains subject to the Provider's posted refund policy and the specific circumstances of the booking.
Assistance by Not School Days does not guarantee that a refund will be approved.
Refund Requests After 14 Days
After fourteen (14) calendar days from the original booking date, Not School Days is not responsible for issuing, funding, guaranteeing, or otherwise providing a refund.
Any refund requested after this 14-day period must be handled directly with the Provider and will be determined according to the Provider's refund and cancellation policy that applied to the booking.
Not School Days may, at its discretion, assist Customers and Providers with communication regarding a refund dispute but is not obligated to issue or fund the refund.
Nothing in these Terms limits any rights or remedies that cannot legally be waived under applicable law.
Provider Cancellations
If a Provider cancels a camp or program, the Provider is responsible for handling any refunds owed to affected Customers in accordance with the Provider's cancellation policy and applicable law.
Not School Days may assist in processing an approved refund through the Platform when technically available but is not responsible for losses, expenses, replacement childcare, travel costs, or other damages resulting from a Provider's cancellation.
7. No Guarantee of Camp Availability
Not School Days does not guarantee that a camp or program will remain available after it is listed.
Providers are responsible for managing their own capacity and availability.
Although Not School Days may provide tools to help Providers manage available spaces, Not School Days is not responsible for Provider overbooking, scheduling errors, inaccurate availability, or cancellations caused by a Provider.
8. Provider Responsibilities
Providers agree that they are solely responsible for operating their camps and programs in compliance with all applicable federal, state, and local laws, rules, regulations, licensing requirements, permits, background-check requirements, insurance requirements, health requirements, and safety standards.
Providers are responsible for determining which laws and regulations apply to their particular operations.
Not School Days does not represent or guarantee that any Provider is licensed, insured, certified, accredited, background checked, or otherwise approved unless the Platform specifically states that the particular credential has been independently verified.
Providers are responsible for the conduct of their owners, employees, contractors, volunteers, counselors, instructors, and other personnel.
9. Parent and Guardian Responsibilities
Parents and guardians are responsible for determining whether a particular camp or program is appropriate for their child.
Before booking, Customers should review the Provider's qualifications, policies, location, activities, age requirements, supervision practices, safety procedures, and any other information they consider important.
Parents and guardians are responsible for providing Providers with accurate information concerning their children, including any information required by the Provider regarding allergies, medical needs, disabilities, emergency contacts, behavioral concerns, or other relevant circumstances.
10. Health, Safety, Injury, and Emergencies
Participation in camps, sports, recreational activities, and other programs may involve risks.
Providers are responsible for establishing and maintaining appropriate safety procedures for their programs.
Not School Days does not supervise participants and is not responsible for injuries, illnesses, accidents, property loss, misconduct, or other incidents occurring before, during, or after a camp or program, except to the extent that liability cannot legally be excluded.
Any emergency involving a participant should be handled directly by the Provider and appropriate emergency services.
11. Disputes Between Customers and Providers
Customers and Providers should first attempt to resolve disagreements directly with one another.
Not School Days may, but is not required to, assist with communications or disputes.
Not School Days does not guarantee the resolution of any dispute between a Customer and a Provider.
Not School Days reserves the right to suspend or remove accounts or listings when it believes a user has violated these Terms or when action is reasonably necessary to protect users or the Platform.
12. Reviews and User Content
Users may be permitted to submit reviews, photos, comments, descriptions, or other content.
Users agree not to submit content that is false, misleading, defamatory, threatening, unlawful, discriminatory, obscene, fraudulent, or that violates another person's rights.
Not School Days may remove content that violates these Terms or Platform policies.
13. Prohibited Conduct
Users may not:
Use the Platform for unlawful or fraudulent purposes.
Provide false or misleading information.
Misrepresent a camp, program, Provider, or participant.
Attempt to interfere with the operation or security of the Platform.
Use another person's account without authorization.
Scrape or copy Platform content without permission.
Circumvent Platform fees through deceptive or fraudulent activity.
Use the Platform in a manner that could harm Not School Days, Providers, Customers, or participants.
14. Suspension and Termination
Not School Days may suspend, restrict, or terminate access to the Platform when a user violates these Terms, engages in suspected fraud or illegal activity, creates a risk to other users, or otherwise misuses the Platform.
Providers may also have listings removed or suspended if Not School Days determines that the listing is inaccurate, misleading, inappropriate, or potentially unsafe.
15. Disclaimer of Warranties
The Platform is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Not School Days makes no warranties regarding the availability, reliability, suitability, quality, safety, or performance of any Provider, camp, activity, or program listed through the Platform.
The inclusion of a Provider or listing on Not School Days does not constitute an endorsement or guarantee by Not School Days.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Not School Days and its owners, officers, employees, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:
A camp or program
The acts or omissions of a Provider
A Provider's employees, contractors, or representatives
A Customer or participant
Cancellation or modification of a program
Injuries or accidents
Loss or theft of property
Inaccurate listing information
Provider overbooking
Disputes between Customers and Providers
Events outside the reasonable control of Not School Days
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
17. Indemnification
To the extent permitted by law, users agree to indemnify and hold harmless Not School Days and its affiliates, owners, officers, employees, and agents from claims, damages, losses, liabilities, and reasonable expenses arising from their violation of these Terms, misuse of the Platform, or violation of applicable law or the rights of another person.
Providers additionally agree to indemnify Not School Days for claims arising from the operation of their camps, programs, employees, contractors, facilities, or services.
18. Third-Party Services
The Platform may use or link to third-party services, including payment processors, mapping services, websites, and other technology providers.
Not School Days is not responsible for the availability, content, policies, or operation of third-party services.
Use of third-party services may be subject to separate terms and privacy policies.
19. Changes to These Terms
Not School Days may update these Terms from time to time.
Updated Terms will be posted on the Platform with a revised “Last Updated” date.
Continued use of the Platform after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
20. Governing Law
These Terms will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any legal proceedings related to these Terms or the Platform will be brought in a court of competent jurisdiction as permitted by applicable law.
21. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
22. Entire Agreement
These Terms, together with any additional policies posted by Not School Days, constitute the entire agreement between you and Not School Days regarding your use of the Platform.
